RULES AND REGULATIONS OF ‘‘SCHOOL LIBRARY ASSOCIATION”
- The name of proposed society shall be namely ‘‘SCHOOL LIBRARY ASSOCIATION”. Hereinafter referred as Society.
- REGISTERED OFFICE
The registered office of the society shall remain in the National Capital Territory of Delhi and at present its office shall be situated at E-37 F/F, KH No 10/10 Jeewan Park, Pankha Road, Uttam Nagar, New Delhi-110059
3. MEMBERSHIP ELIGIBILITY
i) The membership of the Society is open to:Any citizen who has attained the age of maturity (18 Years).
ii) All interested individuals, Institutions, Schools, Associations and those studying towards a Library and Information Science qualification.
NOTE: The reason of refusal for the membership shall be communicated to the person/applicant concerned.
4. ADMISSIONS/ ADMISSIONS FEE & SUBSCRIPTION: –
4.1 Conditions for enrolment as a Member:
A) Any person intending to become a member shall apply in the prescribed form and be introduced by a member of the Association.
B) The subscription shall be for the period from the 1st April of any year to 31st March of the subsequent year, irrespective of the date of admission of a member.
C) Any Indian Citizen who has completed the age of 18 years, non-alcoholic & non-addict, not indulged in any anti-social activities is required to fill and deposit the form prescribed by the Society, to the General Secretary. Such person may be admitted only after the recommendation of President /General Secretary and approval of General/Governing Body of Society.
D) Admission shall be subject to the approval by the Governing Body.
4.2 Categories of Membership
There shall be six (6) categories of membership in the
Association.
i Personal Membership: An individual person will be entitled to be a Personal Member of the Association if: (i) the person agrees with and will work to further the Objects; and (ii) the
person’s application for Membership in this category is approved by the Governing Board.
ii. Association Membership: Open to School Library Associations representing any Indian State or Territory. Association members receive all of the services of personal/institutional members and may send a representative to the Annual General Body meeting of the Association.
iii. Institutional Membership: Open to libraries, school libraries, schools and other educational, corporate and commercial organizations. The name of the official representative/main contact and up to two other contacts may be provided in the membership application and attached to the membership. All representatives receive all benefits.
iv. Student Membership: Any person studying in a recognized
School of Library and Information Science for Certificate, Diploma or Degree may be admitted as a student member.On qualifying at the above referred to Examination, such a member shall be entitled to become a personal member on payment of the membership fee.
v. Retired Membership: Any person who has retired from library and information services or related activities may be admitted as a retired member.
vi. Honorary Membership: An individual person will be entitled to be an Honorary Member if: (i) the person is invited by the Board to be an Honorary Member in recognition of distinguished achievement in furthering the Objects and contribution to the Indian school library profession; and (ii) the individual person’s Honorary Membership in this category is approved by the Governing Board. The number of Honorary Members is limited to Ten (. Honorary Membership is reviewed every two years.
4.3 Membership Fee
A. The Governing Board shall determine the Annual Membership Fee payable by each category of Membership of the Association, including the basis of, the timing of and the manner of payment of such fees.
B. Membership Subscription shall be laid down in the Bye-laws. They may be changed only at an Annual General Meeting of the Association, by a simple majority of the members present.
C. The annual membership fee for different categories of membership shall be as given below.

4.4 Entitlements of Membership: –
i. A personal member has voting privilege on all matters of substance at the Annual General Body Meeting or by mail ballot and may stand for the office, serve on Sub-Committees and participate in Special Interest Groups.
ii. Any person intending to become a member shall apply in the prescribed form and be introduced by a member of the Association.
iii. Admission shall be subject to approval by the Governing Body.
iv. The subscription shall be for the period from the 1st April of any year to 31st March of the subsequent year, irrespective of the date of admission of a member.
v. Association and Institution members have one vote each at the Annual General Body Meeting. The member belonging to this category shall not be entitled to contest for the office.
vi. Each student member and retired member have one vote each at the Annual General Body Meetings; and is not entitled to stand for election for the office.
vii. Each Honorary member may attend the Annual General Body Meetings but doesn’t have the vote; and is not entitled to stand for election for the office.
viii. All members shall be entitled to get a soft copy of the Newsletter and online access to the journal of the Association free of cost.
ix. All members shall be entitled to get other publications of the Association and pay the registration fee for the programes at a concessional rate to be determined from time to time by the Governing Body.
x. All members shall have access to the ‘members only’ section of the official website of the Association, including access to reports, minutes of meetings, selected articles and papers published by and on behalf of the Association.
xi. All members are entitled to join and participate in the email and social media forums/groups/channels managed by the Association.
xii. A right, privilege, or obligation for any class of Membership is not capable of being transferred or transmitted to another person or body corporate; and terminates on cessation / Termination of the Membership.
5. TERMINATION OR CESSATION OF MEMBERSHIP
The membership can be terminated on following grounds:On death and insanity
i. If the member tender resignation in writing.
ii. If found in involved in any unlawful activities.
iii. If adjudged by any court of law to be a criminal offender or of unsound mind.
iv. If found guilty of working against the Aims and Objects of the Society.
v. If fails to pay the subscription or contribution as required within three months.
vi. If disregards rules and regulations or disobeyed the decision of the Governing Body.
Governing Body of the Society shall have the powers to cease or expel or terminate any member from the primary membership of the Society on the above mentioned ground. The decision of the Governing Body to terminate the members of the Society from the Membership will be subject to approval of General Body and shall be communicated to the member concerned.
NOTE: (i) The reason of termination/ cessation from the membership of the Society shall be communicated to the member concerned. (ii) A member expelled from the membership of the society, shall have no right to enjoy the “Rights & Privileges” mentioned in clause No. 7 of these Rules & Regulations.
6. REGISTER OF MEMBERS
The society shall maintain a Register of members containing the names, addresses and their occupations, the date of admission and the details of the cessation of membership. The Register will be kept open for inspection of the members of Society on requisition.
7. RIGHTS, PREVILEDGES AND OBLIGATIONS OF MEMBERS: –
Any member of the Society has the right a) to elect/nominate and to be elected in any election of the Society (b) to submit suggestion for discussion to the Governing Body and Sub-committee on any matter relating to Society; (c) to inspect the accounts and the proceedings of the meetings of the society on appointment with the General secretary; (d) to pay his
subscription within the prescribed time. Defaulting members shall not be allowed to take part or vote in a meeting; (e) have one vote at every meeting; (f) shall be entitled to participate in the meetings cultural or/ and educational functions and other lawful gatherings, called/ arranged by the society; (g) have right to collect the identity card after depositing the required/prescribed fee (fixed by the Governing Body).
8. EXPULSION & REMOVAL
Frequent actions of any members if found by the Governing Body is detrimental to the interest and is in violation of the rules and regulations of the society, he/she may be after due enquiry, censured, suspended or expelled from the Membership by the Governing Body. The Governing Body shall first serve the member concerned with a show cause notice showing therein the charge framed and ask him to submit his statement of defense within 15 days. On receipt of the explanation, the Governing Body shall have the power to take a suitable action against the delinquent member after allowing him to defend his case. If the reply to the showcause notice is not received within 15 days, the Governing Body may take and ex-purse decision. For any act of expulsion or termination no such member shall be entitled to prefer any claim for compensation or damage termination was wrongful and or unlawful.
9. GOVERNING BODY
9.1 Composition
The management and administration of all affairs of the present society Including the management and control of all the branches or regional offices or Run-up or under institute and the control and supervision of other activities taken Up by society together with all its property of any nature or sort shall rest in the Hands of the Governing body. The Governing Body shall consist the Executive Member and the Office bearers as under:

The strength of the Governing Body shall not be less than 8 And not more than 21(twenty-one) members’ i.e. Ten office bearers, Nine elected members and Two co-opted members.
The office bearers of the Governing Body shall comprise of the President, Vice-President, General Secretary, Joint Secretaries, Treasurer and Public Relations Officer. The Office bearers & other Governing Body members shall be elected at the Annual General Body Meeting. The Governing Body of the Association shall have the power to act on behalf of the Association, in all matters except those reserved in the constitution to members at an Annual or Special General Body Meeting.
The resignation and removal of a Governing Body member shall be dealt with as has been prescribed as in the case of other members noted herein before.
9.2 Election of Office Bearers
A. The Governing Body shall decide the date of the General Body Meeting for election process and appoint a Returning Officer to conduct the elections. The procedures adopted and the decisions taken by him/her in all matters pertaining to the election shall be final.
B. Nominations of candidates for election as Office Bearers
(i) Must be made in writing, signed by two (2) Voting Members (as proposer and seconder) of the Association and be accompanied by the written consent of the candidate (which may be endorsed on the nomination form); and
(ii) Must be given to the General Secretary of the Association not less than thirty (30) days before the date fixed for the Annual General Body Meeting.
C. No Personal or Institutional or Association member who has not been on the rolls of the Association for 2 years and has not paid subscription for the current financial year at least a month prior to the date of election, shall be entitled to propose, second, contest and vote at the election.
D. If the number of nominations received is equal to the number of vacancies to be filled, the people nominated are taken to be elected.
E. If the number of nominations received exceeds the number of vacancies to be filled, a ballot must be distributed to Voting Members.
F. The method of voting for Office shall be by simple majority vote.
G. The nomination can be withdrawn by a contestant indicating his/her decision in writing and addressed to the office of the Returning Officer of Association 10 days prior to the date of election.
H. The list of valid nominations will be notified six days before the date of election.
I. The list of members eligible to vote shall be available 20 days before the date of election for consultation on the official website of the Association.
J. The election result shall be announced on the day of election.
K. A person is not eligible to simultaneously hold more than one (1) position on the Body.
L. The Nine (9) non-office bearer members of Body shall be elected from the entire membership of the Association.
M. The two co-opted members shall be nominated unanimously by the all existing eighteen (18) members of the Governing Body.
9.3 Governing Body Meetings
i. The Governing Body must meet at least twice in each calendar year at such place and time as the Governing Body may determine. One of such meeting may be convened immediately after the Annual General Body meeting.
ii. Written notice of a meeting of the Body must be given by the General Secretary to each member of the Body at least 14 Days (or such other period as may be unanimously agreed on by the Board) before the time appointed for the holding of the meeting.
iii. At a Governing Body meeting: (a) the President or, in the President’s absence, the Vice-President is to preside; or (b) if the President and Vice-President are absent one of the remaining Members, may be elected by the Council, to preside as chair of the meeting.
iv. Additional meetings of the Council may be called by the President.
v. Quorum: At least 2/3) Members present in person shall constitute a quorum for the transaction of the business of a Governing Body meeting.
9.4 Terms
i. The President, Vice President, General Secretary, Treasurer, Joint Secretaries and Public Relations Officer are, subject to this Constitution, to hold office for a term of three or five years.
ii. At the expiry of the first term, all Office bearers shall be eligible for re-nomination or re-election (whichever is applicable) for another three or five-years term.
iii. Notwithstanding anything else herein contained, a person shall not hold office as an Office bearer for more than Six (6) consecutive years.
iv. The period of office of all members of the Body shall be three or five years and they shall be eligible for immediate re-election.
9.5 Power and Duties/Functions of the Governing Body
A. The Governing Body, subject to the Act, the Regulation, this Constitution and to any resolution passed by the Association in General Meeting:
i. is to control and manage the affairs of the Association;
ii. is to admit new members;
iii. is to form ad-hoc sub-committees to advise on or deal with specific problems;
iv. to define the duties of the office-bearers;
v. to appoint full-time /part time paid staff, if necessary;
vi. to convene annual/ special /extra-ordinary meeting of the General Body;
vii. to frame necessary bye-laws;
viii. to appoint Special Interest Groups & Sub/Standing committees, from amongst its members or in Association with suitable non-members, and delegate such powers to them as it may deem proper.
ix. to constitute an Advisory Board, including persons who need not be members of the Governing Body with such Advisory Functions as it may think proper.
x. to accept gifts, grants, donations and endowments and administer the same in fulfillment of the objectives laid down for the purpose;
xi. to perform such other activities which are conducive to the furtherance of the objectives of the Association;
xii. may exercise all such functions as may be exercised by the Association, other than those functions that are required by this Constitution to be exercised by the Association in General Body Meeting;
xiii. has power to co-opt members to the Body in accordance with Clause 9.1; and
xiv. has power to perform all such acts and do all such things as appear to the Body to be necessary or desirable for the proper management of the affairs of the Association;
B. The Governing Body shall inter alias be authorized to:
i. Sell transfer charge, mortgaged hypothecate, pledge, demise, dispose of or otherwise deal with any of the properties moveable or immoveable belonging to the society for the benefit of the society.
ii. Transfer or confirm appointments, sanction scales of pay and the terms and conditions of service of the employees of the society.
iii. Promote the exchange of national and international experience for increasing participation of interested people in National Building Activates.
iv. Provide consultancy service to Governmental and non-governmental bodies on matters include in the object of the society.
v. Undertake publication of printed or online journals, magazines, books, proceedings, leaflets, newsletters and posters to fulfill the objects of the society.
vi. Arrange finance if required from bank(s), Institution(s) or individual (s) on reasonable terms and conditions and liable for the repayment of finance so arranged.
vii. Frame suitable rules, regulations and bye-laws for promoting the work of society. Select office bearers and delegate such powers to them as it may deem fit for the conduct of business.
viii. Prepare the annual report and audited accounts of the Society. Take all necessary legal action to protect the interest of the society and do all such acts, deeds, and things as are incidental or conducive to the attainment of any or all the object of the society.
ix. The Governing Body is authorised to appoint/nomination any time Advisor Board to solve any matter/issue.
x. Raise funds through donations, grants endowments, gifts, bequests subscriptions contributions, sale or purchase, in cash or kind.
xi. Borrow money, and raise loans with or without security of mortgage, charge hypothecation or pledge over all or any of the property, moveable or immoveable belonging to the society. Any decision of the Body may be overruled by two-thirds majority of the members present, at any Annual or Extra Ordinary General Body Meeting.
10. GENERAL BODY
All the members who have recognized by the Governing Body shall constitute the General Body of the Society. The Final Authority in a Society shall vest in the General Body of the Members.
10.1 Power and Duties/Functions of the General Body
All and every member of the society shall: –
i. attend the General Body meetings and administer the oath of the office and loyalties to the society and/or its constitution.
ii. elect, suspend or remove member of the Governing Body and any office bearer of Society. Members in such situation can elect any other person of their consensus
iii. receive from Governing Body or any committee annual report on the preceding year’s working of the Society together with a statement showing the receipt and expenditure, assets and liabilities and profit and loss for the year and approve the same.
iv. not indulge in activities which are prejudicial to the interest of the Rules & Regulations of the society
10.2 Functions of the General Body
i. Notice
Not less than 30 days’ clear notice shall be given to the members before the Date of General Body Meeting, enclosing the agenda specifying Date, Time, Place and the General nature of Business to be discussed at such meeting.
ii. Meeting
General Body Meeting shall be held at least once in every year on such a date as shall be determined by the Body to transact the following business:
- Adoption of the Annual Report
2. Passing of the audited Accounts
3. Presentation of Annual Budget
4. Consideration and adoption of resolutions, if any
5. Amendments to the Memorandum of the Association and Rules & Regulations of the Association, if any.
a) Any extra-ordinary meeting of the General Body shall be convened by the General Secretary on receipt of a requisition from two-third of the members.
b) A question arising at a General Body Meeting of the Association is to be determined on a show of hands and, unless before or on the declaration of the show of hands a poll is demanded, a declaration by the chair that a resolution has, on a show of hands, been: (a) carried; or (b) carried unanimously; or (c) carried by a particular majority; or (d) lost, or an entry to that effect in the minute book of the Association, is evidence of the fact without proof of the number or proportion of the votes recorded in favour of or against that resolution.
c) All votes must be given personally or by proxy, but no Member may hold more than five proxies. The notice appointing the proxy is to be in the approved by the Governing Body.
d) In the case of an equality of votes on a question at a General Meeting, the chair of the meeting is entitled to exercise a second or casting vote.
e) The President/Vice-President shall preside over the Ordinary/Extra-Ordinary General Body Meeting. However, in the absence of the above- named officers, the General Body shall elect a person from amongst the other office-bearers to preside and conduct the business.
iii. Quorum
a. At least 2/3 Members present in person, who are entitled under this Constitution (including office bearers and members of Governing Body) to vote at a General Body Meeting, constitute a quorum for the transaction of the business of a General Body Meeting.
b. If the required quorum is not attended in any meeting it shall be adjourned for a further period of 15 days. At such adjourned meeting, no quorum shall be required / necessary.
12. RIGHTS & PRIVILEGES MEMBERS
All and every member of the society shall be entitled to participate in meetings, cultural & education functions and other lawful gatherings, called/arranged by the Society.
13. DUTIES OF THE MEMBERS
All member of the Society shall have following duties:
i. To participate in the activities of the Society.
ii. To attend the meetings of the society.
iii To give the necessary information to the society, pertaining to any matter which is necessary to be known by the Society.
iv. Not to indulge in activities, which are prejudicial to the Aims and Objects and/or the Rules & Regulations of the Society.
14. SERVICE OF NOTICES
For the purpose of this Memorandum and Rules and Regulations, a notice may be served on or given to a person:
a. By delivering it to the person personally; or
b. By sending it by pre-paid post to the address of the person; or
c. By sending it by facsimile transmission or some other form of electronic transmission to an address specified by the person for giving or serving the notice.
15 DUTIES AND RESPONSIBILITIES OF OFFICE BEARERS
A. President
i. The President shall preside over the Governing Body/Ordinary General Body/ any extra –ordinary General Body Meeting of the Association.
ii. The President shall perform all such functions as are warranted by the constitution and the Bye-laws framed there under.
iii. The President shall incur or sanction expenditure upto Rs.10000/- at a time.
iv. The President shall act as Liaison Officer between the Association on the one hand, and the Governments and other Associations on the other hand.
v. In any emergency, in which in the opinion of the President immediate action is required, the President
shall after considering the opinion of the General Secretary and Treasurer of the Association, take such action as he/she thinks necessary and shall report the action taken by him/her to the Council at its next meeting for approval and confirmation.
vi. In the event of illness/ resignation/death etc. of the President, the Vice President will be the Acting President till the next election.
B. Vice President
i. The Vice President shall preside over the Governing Body/Ordinary General Body/ any extra –ordinary General Body Meeting of the Association in the absence of the President.
ii. The powers and duties of the Vice-President shall be to act in place of the President during his/her absence or on such occasions as may be determined by the President.
C. General Secretary
Subject to the direction of the Council, the powers and duties of the General Secretary shall be as follows:
i. To administer the business of the Association.
ii. To incur or sanction expenditure up to Rs. 5000/- at a time.
iii. To attend the meetings of General Body and the Governing Body and to maintain the minutes of their proceedings. Minutes of proceedings at a meeting must be signed by the person presiding at the meeting or by the person presiding at the next succeeding meeting.
iv. To prepare the Annual report on the working of the Association for consideration by the Council and the General Body.
v. To issue notices convening meeting of the Association and the Council.
vi. To conduct and receive the official correspondence of the Association.
vii. To keep the members informed of the activities of the Association.
viii. To sign agreements or contracts on behalf of the Association.
ix. The General Secretary may delegate his/her authority to one of the Joint Secretaries in consultation with the President/Vice-President, in case of his/her absence.
D. Joint Secretaries
The powers and duties of the Joint Secretaries shall be as follows:
i. To assist the General Secretary in the discharge of his/her duties on all occasions and in the manner as may be defined by the Governing Council.
ii. The Governing Council may authorise one of the Joint Secretaries to act in the place of the General Secretary in his/her absence.
E. Treasurer
Subject to the direction of the Governing Body, the powers and duties of the Treasurer shall be as follows:
i. To receive all moneys on behalf of the Association and to issue properly signed receipts for the same.
ii. To assist the General Secretary in the discharge of his/her duties on all occasions and in the manner as may be defined by the Governing Body.
iii. To open current/savings account and fixed deposit account with any bank approved by the Governing Body and to operate them in the manner prescribed by the Governing Body.
iv. To be responsible for the charges inured under competent authority.
v. To make payments for the collection of the funds of the Association.
vi. To maintain the accounts, to prepare the Annual statement of Accounts and the Budget and to present the annual statement of accounts together with the Audit Report and the Annual Budget for the consideration of the Governing Body and the General Body.
vii. To maintain and present an up-to-date statement of accounts at every meeting of the Governing Body.
viii. The Treasurer shall be the principal Finance and Disbursing Officer of the Association.
F. Public Relations Officer
Subject to the direction of the Governing Body, the powers and duties of the Public Relations Officer shall be as follows: –
i. The Public Relation Officer will manage the reputation of the Association.
ii. To use all forms of media and communication to build, maintain and manage the reputation of the Association.
iii. To communicate key messages of the Association, endorsements, to its members in order to establish and maintain goodwill and understanding between the Association and its members.
iv. To monitor publicity and conduct research to find out the concerns and expectations of the Association’s stakeholders. He/she shall then report and explain the findings to the Council of the Association.
16. COMPOSITION OF SPECIAL INTEREST GROUPS AND SUB COMMITTEES
The Governing Body will form or constitute the Special Interest Groups/ Sub Committees/Standing Committees on School Library Research, School Library Education & Training, Publications, Information Literacy, Advocacy, Information and Communication Technologies and Finance amongst the members of the General Body according to their taste and interest in the area of work.
17. RE-ADDMISSION
In case, any member of the society is expelled by the Governing Body on the reason of non-payment of the subscription, he/she can be re-admitted provided the member concerned pay all up to date dues with the permission of the Governing Body.
18. APPEALS
Appeals can be made against decisions of Governing Body before the General Body of the society and the decision of the General Body shall be final. The decision of the General Body shall be communicated to the member concerned.
19. FILLING OF THE CASUAL VACANCIES
Any casual vacancy amongst the Office bearers and Executive Members of the Governing Body arising from death, or otherwise shall be filled by the resolutions passed by the majority of votes by the Governing Body and such appointment or the appointments shall be confirmed by the General Body Meeting. In the event of any Executive Member or office bearer’s seat falling vacant, the powers and functions (except voting right) of that person/ member would vest in the President.
20. ELECTION:
The General Body in its Annual Meeting will elect its President and all the office bearers and also the Executive Members of the Governing Body after every subject to (three or five years), by secret ballot papers or by show of hands as the election officer may decide. The Election Officer will be appointed
by the Governing Body Meeting called for this purpose. The powers of the Elections Officer shall be framed in the same meeting to complete the election proceedings.
21. SOURCES OF INCOME
All the income of the society shall be utilized only for the promotion and up-liftment of the Aims and Object of the society. Sources of Income of the society are as under: –
i. Annual subscriptions of Members;
ii. Donations, special contributions, gifts or endowments;
iii. Funds generated through conducting of workshops/ seminars/ training / programs, sale of publication and periodicals or any other income generating activities.
iv. Funds collected through various legal mechanisms, including loans/borrowings from other sources.
v. Such other sources as the Council determines, subject to any resolution passed by the Association in General Meeting.
22. FINANCIAL MATTERS
A. The Society shall have the following powers regarding finance, possession of property, etc.:
i. To receive and collect any gift, subscriptions and donations either in cash or in kind or acquire by any other lawful ways and means and spend the same in fulfilment of all or any its aims and objects. The income and property shall be applied solely for its promotion and fulfilment of its aims and objects. Provided if any donor intends his donations or subscriptions shall be applied to attain any particular objects of the society contributions, donations and subscriptions shall be spent towards the promotion of its particular objects only;
ii. To borrow and raise money as it may think fit;
iii. To receive, accepts, purchase, sell, take on lease, exchange acquired any moveable immoveable properties or a right privileges necessary on such items and conditions as many be thought fare on expedient for fulfilling the aims and object of the society after approval by the competent authority;
iv. To execute such documents as may be deemed necessary for the above transactions.
B. The funds and other assets of the Society shall vest in the Governing Body of the Society.
C. The Governing Body shall have power to make reasonable payments in respect of expenses or fees to any person performing special services for the Association at the request of the Governing Body.
D. No payment in the nature of a fee or salary shall be made to any officer.
E. An officer or other representative who travels outside India on behalf of the Association will have part or all the expenses approved refunded.
F. The Treasurer shall keep all financial records and be responsible for receiving and paying out all monies on behalf of the paid-up members of the Society, and communicate this to the General Secretary from time to time.
G. The Treasurer shall draw up a balance sheet and statement of accounts at the end of each financial year. He shall submit these for audit together with all records, receipts, cheque books, bank statements and any other documents requested by the Auditor, not later than 31st January next following the end of the financial year.
H. The finance and property of the Society shall be utilized solely for the purpose of the Objects of the Society in the manner approved by the Governing Body.
I. Any member of such Governing Body except repayment of out of pocket expenses and interest on money lent or rent for premises/demises to the Association.
J. The Association by its constitution is required to apply its profit, if any, or other income in promoting its objects.
K. If upon the winding up or dissolution of the society there remains after satisfaction of all its debts and liabilities any property whatsoever, the same shall not be paid to or distributed among the members of the Society, but shall be given or transferred to some other Institution having objects similar to the objects at the Society to be determined by the members of the Society at or before the time of dissolution.
L. Financial Year: Financial year of the Society shall be from 1st April to 31 March.
M. Audit : The accounts of society shall be audited by a qualified auditor (Chartered Accountant) every Year. Who shall not be an Office Bearer, to carry out an audit of all its books and accounts at the end of each financial year. Such an audit report shall be tabled at the next meeting of the Governing Body following its receipt.
N. Management of Funds & Accounts Operation: The Society shall keep its funds in a scheduled bank, corporate bank or any other nationalized bank as per regulation of Reserve Bank of India except such funds are required as petty cash. President/General Secretary and Treasurer shall operate bank accounts and financial matters also.
- BANK ACCOUNT OPERATIONS:
The Bank account/accounts of the society shall be operated by the Joint Signatures of Treasurer and any one out of President and the Secretary of the society and any Authorised Represented (A.R.)
23. ANNUAL LIST OF MEMBERSHIP
Once in every year a list of the Office Bearers and the Executive Members (of the Governing Body) shall be filled in the Office of the Registrar of societies, Delhi as it is required under Section 4 of Societies Registration Act, 1860.
24. DISSOLUTION
If the Society needs to be dissolved, as per provision laid down under the Sec.13 & 14 of the Societies Registration Act, 1860 as application to National Capital Territory of Delhi.
25. LEGAL PROCEEDINGS
Society may sue and/sub/or be sued in the name of PRESIDENT as per provisions laid down under section 6 of the Societies Act, 1860, as applicable to National Capital Territory of Delhi.
26. AMENDMENT
Any amendment in memorandum, rules and Regulations will be carried out in accordance with the section 12 & 12A of the Societies Registration Act, 1860, as applicable to National Capital Territory of Delhi.
27. APPLICATION OF THE ACT
All the provisions under all the sections of “Societies Registration act, 1860” as applicable to National Capital Territory of Delhi, shall be applicable to this society.
